Criminal liability

The doctor is subject to the rules of common law, like any citizen. It can therefore be prosecuted criminally, when the non-observance of the ethical and ethical prescriptions affects the social order by prejudicing the patient. The provisions of article 289 of the Penal Code for homicide and injuries caused by clumsiness, carelessness, carelessness, negligence or non-observance of the regulations are applicable to the physician for personal injuries caused in the performance of his / her duties. Criminal responsibility is personal; In other words, it can not be covered by insurance. It may result in fines and / or imprisonment.
